Nozick appealed to the Kantian idea that people should be treated as ends what he termed 'separateness of persons' , not merely as a means to some other end. Nozick challenged the partial conclusion of John Rawls' Second Principle of Justice of his A Theory of Justice , that "social and economic inequalities are to be arranged so that they are to be of greatest benefit to the least-advantaged members of society. Most controversially, Nozick argued that a consistent upholding of the non-aggression principle would allow and regard as valid consensual or non-coercive enslavement contracts between adults.

This formulation is not redistributive, nor does it consider rights as goals, but rather as side-constraints on what we can do. Some people will opt not to enter into our hypothetical social contract, but for the dominant protective association to protect its members from the fear of these independents, they must be forced to incorporate. Nozick thinks that if members could compensate the independents for this rights violation, it would legitimize the state. Incautious critics sometimes take this to mean that Nozick simply assumes rights and then proceeds from there, but he does have an argument for rights. Rawls argues that the state should have whatever powers are necessary to ensure that those citizens who are least well-off are as well-off as they can be though these powers must be consistent with a variety of basic rights and freedoms. One legitimate means is the appropriation of something that is unowned in circumstances where the acquisition would not disadvantage others. A second means is the voluntary transfer of ownership of holdings to someone else.
It substantially responds to Rawls, despite ranging over many topics. That is, Rawls depicts bargainers as separate consumers , entitled to separate shares , while dismissing the separateness of what they do as arbitrary. Part II continues to pound on the incongruousness of respecting our separateness as consumers see his discussions of distributing grades and mates while implicitly denigrating and even denying our separateness as producers. Part III argues that true utopia would not impose a favored vision of utopia while silencing incompatible rivals.
