PESHAWAR, Oct 8 The commissioner of Peshawar division on Thursday notified a policy for streamlining price control measures in what appears to be a mere reminder to officials to exert their authority already guaranteed under different laws.

The policy, issued by the commissioner to district coordination officers of Peshawar, Charsadda and Nowshera, reads that the provincial government through different notifications had delegated powers to officials concerned for price control, but due to lack of knowledge and expertise the delegated powers are not exercised properly.

To tackle this issue, a two-day crash training programme will be arranged this week in Peshawar to educate price magistrates. The director general prosecution , NWFP, and legal advisor of the commissioner office, will give lectures on relevant sections of substantive and procedural laws.

The magistrates will be imparted training about procedures for trial of violators, summary trial, bail matters and their disposal, and maintenance of record of cases for regular and summary trials, says the new policy. District prosecutors will provide legal assistance to the magistrates in exercise of powers as well as at the time of execution proceedings in their respective districts.

Similarly, the DCOs, as required in the policy, will hold coordination meetings between magistrates and prosecution, fortnightly. At the moment, price control measures adopted in the division are at variance, with each district moving to a different tune and quantum of punishment, regularity of raids and applicability of laws, causing perplexity and resulting into ineffectiveness of the system. To this end, the new policy bounds the DCO to divide the district into zones on the basis of jurisdictions of police stations and town committees to be supervised by a price magistrate.

Every magistrate will ensure price checking in his area for at least one to two hours, five days a week, and a report of his inspections should be sent to the commissioner's office on weekly basis. Likewise, the magistrates have been directed to conduct regular trials and impose fines, the quantum of which should be substantive so as to act as a deterrent for violators, as presently the fines imposed and imprisonment awarded by them is negligible an merely symbolic. Price control measures, the policy maintains, should primarily be focused on big wholesale dealers and retailers, instead of just petty shopkeepers.

It may be mentioned here that maximum punishment under the Price Control and Prevention of Profiteering and Hoarding Act, , is imprisonment for up to three years and a fine up to Rs, The DCOs of Peshawar, Charsadda and Nowshera have also been directed to depute the rationing controller and representative of the town administration concerned to supervise and gear up the auction daily.

Similarly, random checking of auction proceedings will also be conducted by the price magistrate in his respective area. The supervisory staff, while fixing the rate at the time of auction, will keep in mind that the rate fixed is affordable and fair to both the seller and the end user by eliminating the role of middlemen.

The district authorities have been directed to ensure schedule of rates or price list of the commodities is displayed at conspicuous places as well as shops, and regular checking of the same by the price magistrates. Directives for availability of police for price checking and curbing smuggling of edible items to adjoining tribal regions of Khyber and Mohmand and removing encroachments are also part of the new policy.

This Act may be called Price Control and Prevention of profiteering and Hoarding Act, and is enacted to provide for price control and prevention of profiteering and hoarding. It is applicable to whole of Pakistan. The Federal Government may delegate power for the purpose of this act to officer or authority subordinate to the Federal Government or Provincial Government or such officer or authority subordinate to a Provincial Government.
